Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Health and Human Services Boardroom at 5:30 p.m. Members present: V Fixmer-Oraiz, Jon Green, Lisa Green-Douglass, and Rod Sullivan. Members absent: Royceann Porter.
Unless otherwise noted, all actions were taken by the following vote: Roll call: Aye: Fixmer-Oraiz, Green, Green-Douglass, Sullivan; Absent: Porter.
The room took a moment of silence to honor the life of Conservation Director Larry Gullet.
PUBLIC COMMENT
Resident Michael Eichhorn said he owns land in Johnson County and was instructed by Planning, Development, and Sustainability (PDS) staff to rezone the property from A-Agricultural to R-Residential before he can build on the property. He is concerned about the time and costs involved with the rezoning process, and said he already pays residential taxes on the property.

Convened Public Hearing at 5:39 p.m. on Subdivision Application PZC-24-28536 of Lawrence & Tamara Murphy, requesting preliminary and final plat approval of Murphy Acres. Convened Public Hearing at 5:55 p.m. on the Future Land Use Map Amendment Application FLUM-24-28544 of Jeff Carew, requesting re-designation of approximately 56.25 acres from Agricultural and Conservation Development to Residential. The property is located at 2367 Highway 6 NW, south of the intersection with Greencastle Ave NW, in the NE 1/4 of Section 30, Township 80 North, Range 7 West of the 5th P.M. in Cleer Creek Township, Johnson County, Iowa.
PDS Planner Maya Simon reviewed the application. Green-Douglass raised concerns about the site due to its proximity to Highway 6 and sensitive areas. She said a new subdivision on the property will lead to increased traffic. Ritter noted that the applicant plans to subdivide the property, allowing for bus access and two entry points. Dylan Crew, a family member of the applicant, said the family came to an agreement with Johnson County Conservation to construct a bike trail that will connect to trails leading to the City of Tiffin. There were no further public comments. Public Hearing closed at 6:21 p.m.
RESOLUTION NO. 09-12-24-04
RESOLUTION APPROVING THE REQUEST SUBMITTED BY JEFF CAREW TO AMEND THE FUTURE LAND USE MAP OF THE
JOHNSON COUNTY
2018 COMPREHENSIVE PLAN
Summary: The Board of Supervisors adopted the current comprehensive plan on May 17, 2018, and has adopted procedures to consider and incorporate updates to the Future Land Use Map (FLUM). Application FLUM-24-28544 has been filed to change the category of the property located at 2367 Highway 6 NW from Agricultural to Residential. The Planning and Zoning Commission forwarded to the Board a position of “No Recommendation” on the proposed amendment. Board Action: Approve the amendment as requested by FLUM-24-28554; the FLUM designation of the property located at 2367 Highway 6 NW, south of the intersection with Greencastle Ave NW, in the NE 1/4 of Section 30, Township 80 North, Range 7 West of the 5th P.M. in Cleer Creek Township (commonly known as PPNs 06-30-127-001, 06-30-151-001, and 06-30-177-002 at the time of this approval) be changed from Agricultural to Residential as shown on the FLUM Amendment Exhibit included in the packet for the September 12, 2024, Board of Supervisors Formal meeting; and the PDS Director be directed to update the FLUM accordingly. Convened Public Hearing at 6:27 p.m. on the proposed ordinance amending the text of the Johnson County Unified Development Ordinance by updating and adding certain definitions; modifying allowed uses in certain zoning districts; updating, adding, and clarifying certain supplemental conditions; updating, adding, and clarifying certain additional regulations related to yard and area requirements, signs, fencing, parking, and temporary storage; updating, adding, and clarifying certain Site Plan regulations; updating and clarifying certain development application requirements and procedures; updating and clarifying certain subdivision regulations and procedures related to plat expiration and renewal, lot access and road standards, and legal documents; updating certain floodplain and building code regulations. Said ordinance shall apply to all property located in the unincorporated areas of Johnson County.
Assistant PDS Director Nate Mueller reviewed the draft omnibus ordinance amendment proposing various changes to the Unified Development Ordinance (UDO) as outlined in the agenda packet of the meeting. He discussed the nature of the proposed amendments and clarified ministerial changes. The Board agreed to communicate any desired changes to the proposed ordinance amendment language ahead of the public hearing process. No one from the public spoke. Public Hearing closed at 6:37 p.m.

RESOLUTION NO. 09-12-24-05
RESOLUTION SETTING A PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE JOHNSON COUNTY UNIFIED
DEVELOPMENT ORDINANCE
Summary: The Planning and Zoning Commission has filed its report and recommendations for certain actions. Board Action: Set a public hearing for September 26, 2024, at 9:00 a.m. CT in Room 203 B/C, Johnson County Health & Human Services Building, 855 South Dubuque Street, Iowa City, Iowa, on the following applications and proposed amendment: An ordinance amending purposes and County Unified Development Ordinance to add cryptocurrency production as an allowed use, modify acreage regulations related to detached Auxiliary Dwelling Units, add provisions for treating a parcel group as a single parcel for building purposes, and modify lot of record regulations. Authorize the Auditor to publish the official notice of the above public hearing. Motion by Green, second by Green-Douglass, to approve Resolution No. 09-12-24-05.
RESOLUTION NO. 09-12-24-06
RESOLUTION SETTING A PUBLIC HEARING ON VARIOUS DEVELOPMENT APPLICATIONS
Summary: The Planning and Zoning Commission has filed its report and recommendations for certain actions. Board Action: Set a public hearing for October 10, 2024, at 5:30 p.m. CT in Room 203 B/C, Johnson County Health & Human Services Building, 855 South Dubuque Street, Iowa City, Iowa, on the following applications: Zoning applications filed by Brian & Julie Rustand (PZC-24-28559); Richard Schooley (PZC-24-28560); Doug Black (PZC-24-28561); and Platting application filed by the Estate of William J Leonard (PZC-24-28562). Authorize the Auditor to publish the official notice of the above public hearing. Motion by Fixmer-Oraiz, second by Green, to approve Resolution No. 09-12-24-06.

RESOLUTION NO. 09-12-24-07
RESOLUTION TO FIX A DATE FOR A PUBLIC HEARING ON AN AMENDMENT TO A 2023 GENERAL OBLIGATION LOAN AGREEMENT TO FINANCE THE ACQUISITION OF PEACE OFFICER COMMUNICATION EQUIPMENT AND OTHER EMERGENCY SERVICES COMMUNICATION EQUIPMENT AND SYSTEMS IN THE AMOUNT
OF $1,200,000
WHEREAS, Sections 331.402, 331.441 and 331.443 of the Code of Iowa authorize counties to enter into loan agreements and borrow money for the purposes of financing improvements to county buildings and acquiring peace officer communication equipment and other emergency services communication equipment and systems (each an “Essential County Purpose”); and
WHEREAS, the Board of Supervisors (the “Board”) of Johnson County, Iowa (the “County”), pursuant to the provisions of Sections 331.402, 331.441 and 331.443 of the Code of Iowa, previously authorized a loan agreement (the “County Farm Building Renovations and Improvements Loan Agreement”) for the purpose of paying costs, to that extent, of renovations and improvements to the County Farm Building in the amount of $1,200,000, an Essential County Purpose (the “County Farm Building Project”), which County Farm Building Renovations and Improvements Loan Agreement was consolidated into the Series 2023 Loan Agreement (the “Series 2023 Loan Agreement”) entered into in connection with the issuance by the County of its Taxable General Obligation County Purpose Bond in the principal amount of $12,920,399 (the “Series 2023A Bond”) and a Taxable General Obligation County Purpose Bond in the principal amount of $4,009,000 (the “Series 2023B Bond” and, together with the Series 2023A Bond, the “Series 2023 Bonds”) in evidence of the County’s obligation under the Series 2023 Loan Agreement; and
WHEREAS, the County determined not to proceed with the County Farm Building Project, and now desires to amend the Series 2023 Loan Agreement to use a portion of the Series 2023 Bonds to acquire peace officer communication equipment and other emergency services communication equipment and systems in the amount of $1,200,000, also an Essential County Purpose (the “Communication Equipment Project”); and
WHEREAS, the Board desires to enter into an amendment to the Series 2023 Loan Agreement (the “Series 2023 Loan Agreement Amendment”) to provide for the use of the proceeds of the Series 2023 Bonds in the amount of $1,200,000 for the Communication Equipment Project; and WHEREAS, it is necessary to fix a date of meeting of the Board at which it is proposed to take action to enter into the Series 2023 Loan Agreement Amendment, and to give notice thereof; and
NOW, THEREFORE, Be It Resolved by the Board of Supervisors of Johnson County, Iowa, as follows:
Section 1:This Board shall meet on October 3, 2024, at the Johnson County Administration Building, Iowa City, Iowa, at 9:00 a.m., at which time and place a hearing will be held and proceedings will be instituted and action taken to enter into the Series 2023 Loan Agreement Amendment.
Section 2:The County Auditor is hereby directed to give notice of the proposed action on the Series 2023 Loan Agreement Amendment, setting forth the amount and purpose thereof, the time when and place where the said meeting will be held, by publication at least once and not less than 4 nor more than 20 days before the meeting, in a legal newspaper of general circulation in the County. Section 3. The Series 2023 Loan Agreement Amendment notice shall be substantially as follows:
NOTICE OF PUBLIC HEARING ON LOAN AGREEMENT AMENDMENT FOR AN ESSENTIAL COUNTY PURPOSE IN A PRINCIPAL AMOUNT OF $1,200,000
(GENERAL OBLIGATION ESSENTIAL COUNTY PURPOSE)
The Board of Supervisors of Johnson County, Iowa, will meet on October 3, 2024, in Room 203 B/C, Johnson County Health and Human Services Building, 855 South Dubuque Street, Iowa City, Iowa, at 9:00 a.m. for the purpose of instituting proceedings and taking action to enter into an amendment to a loan agreement (the “Series 2023 Loan Agreement Amendment”) for the purpose of defraying all or a portion of the cost of the acquisition of peace officer communication equipment and other emergency services communication equipment and systems in an amount of $1,200,000. The Series 2023 Loan Agreement Amendment is proposed to be entered into pursuant to authority contained in Sections 331.402, 331.441 and 331.443 of the Code of Iowa and will constitute a general obligation of the County. At that time and place, oral or written objections may be filed or made to the proposal to enter into the Series 2023 Loan Agreement Amendment. Sullivan deferred item F.1.i. Consider Quality of Life Grant Agreement with Johnson County Chapter of Pheasants Forever #230 in the amount of $5,000 to a future Board Meeting.
Motion by Green, second by Green-Douglass, to approve the Fiscal Year 2025 Service Agreement between the Johnson County Board of Supervisors and the Johnson County Agricultural Association, in an amount not to exceed $41,300.
Motion by Fixmer-Oraiz, second by Green-Douglass, to approve the Fiscal Agent Agreement between the Johnson County Empowerment Board/Early Childhood Iowa Area Board and the Johnson County Board of Supervisors for the Infant and Toddler Scholarship Program, effective September 16, 2024.
Motion by Green, second by Green-Douglass, to approve repealing and replacing in its entirety Volume One of the Johnson County Code of Ordinances, on second consideration. Roll call: Aye: Fixmer-Oraiz, Green, Green-Douglass, Sullivan; Absent: Porter.
