Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Health and Human Services Boardroom at 5:30 p.m. Members present: V Fixmer-Oraiz*, Jon Green, Lisa Green-Douglass, Royceann Porter, and Rod Sullivan.

Motion by Green, second by Porter, to receive and place on file the Clerk’s Report of Fees Collected for the month of September 2024, in the amount of $36,298.17, as submitted by Clerk of District Court Alison Meade.
Convened Public Hearing at 5:34 p.m. on Zoning Application PZC-24-28559 of Brian and Julie Rustand, requesting rezoning of 0.27 acres from A-Agricultural to R-Residential and 0.53 acres from R-Residential to A-Agricultural. RESOLUTION NO. 10-10-24-01
RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT
AND SUBDIVIDER’S AGREEMENT OF LEONARD TIMBER ADDITION,
JOHNSON COUNTY, IOWA
Summary: Application PZC-24-28562, the preliminary and final plat of Leonard Timber Addition
Johnson County is submitted for approval. Board Action: Approved the plat, directed the plat and Subdivider’s Agreement be signed, and named the documents to be recorded. Motion by Green, second by Porter, to approve Resolution No. 10-10-24-01, effective October 10, 2024.
Convened Public Hearing at 5:47 p.m. on an ordinance amending Chapter 4. Public Order, Safety and Health, Article 4:1 Fireworks, of the Code of Ordinances of Johnson County, to add new definitions, application requirements, minimum separation distances, and fallout areas, and to allow for the discharge of consumer fireworks during certain defined periods of time without a permit.
PDS Director Josh Busard reviewed the proposed ordinance amendment. Medicine River Farms Owner Gene Wehrheim spoke in favor of the proposed ordinance amendment. Public Hearing closed at 6:06 p.m.

ORDINANCE NO. 10-10-24-01
AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE TO ADD CRYPTOCURRENCY PRODUCTION AS AN ALLOWED USE, MODIFY ACREAGE REGULATIONS RELATED TO DETACHED AUXILIARY DWELLING UNITS, ADD PROVISIONS FOR TREATING A PARCEL GROUP
AS A SINGLE PARCEL FOR BUILDING PURPOSES, AND
MODIFY LOT OF RECORD REGULATIONS
Summary: The purpose of this ordinance is to amend the Unified Development Ordinance as provided below and summarized in the final third reading motion. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. If any section, provision, or part of this ordinance shall be adjudged invalid, illegal, or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged, invalid, illegal or unconstitutional. Effective Date: This ordinance shall be in effect after its final passage and publication as part of the proceeding of the Board of Supervisors.
Amendments.
1. Article 8:1.7 is hereby amended by adding a new subsection 8:1.7.M which reads as follows: M. The Zoning Administrator may treat a parcel group as a single parcel for zoning and building purposes where all of the following exist: a) All parcels included in the request were platted prior to December 31, 1976, and b) All parcels included in the request have the same zoning designation, and c) The property(ies) included in the request have been owned, held and used as a single, unified parcel group in their current configuration since at least December 1, 2000; and d) Underlying Johnson County Public Health septic density regulations would otherwise prohibit replatting to combine the lots/parcels; and e) The property owner shall provide a covenant or other form of deed restriction, in a form provided by or acceptable to Johnson County and suitable for recording with the County, putting prospective future buyers or owners of the property on notice that the parcels are restricted as set forth herein and may not be transferred separately; and providing that the properties may only be transferred separately upon release of said covenant or deed restriction in writing by the Zoning Administrator.

4. Article 8:1.23.D.4.a is hereby amended by deleting the words “two (2) acres” and replacing them with the words “one (1) acre”.
5. Article 8:1.23.D.4.b is hereby amended by deleting the words “two (2) acres” and replacing them with the words “one (1) acre”.
6. Article 8:1.29.G.2 is hereby amended by adding the words, “Excepting the A-Agricultural District,” before the words, “In any district”.
Motion by Green, second by Porter, to approve the proposed ordinance amending the text of the Johnson County Unified Development Ordinance by adding cryptocurrency production as an allowed use, modify acreage regulations related to detached Auxiliary Dwelling Units, add provisions for treating a parcel group as a single parcel for building purposes, and modify lot of record regulations, on third and final consideration and approve Ordinance No. 10-10-24-01, amending the Johnson County Unified Development Ordinance. Roll call: Aye: Fixmer-Oraiz, Green, Green-Douglass, Porter, Sullivan.
Motion by Green, second by Green-Douglass, to set a public hearing on the Fiscal Year 2025 County Budget Amendment, for October 31, 2024, at 9:00 a.m. in the Health and Human Services Building Boardroom 203C and authorize the Auditor to publish the notice of public hearing.
Motion by Green, second by Porter, to deny the request for tax abatement from North Liberty Community Pantry, as contained in the agenda packet of the meeting.
Motion by Porter, second by Green, to approve the Provider Participation Agreement with the Iowa Department of Health and Human Services, Des Moines, for participation in the Ground Emergency Medical Transportation Uncompensated Cost Prospective Payment Program for Fiscal Year 2025.
Motion by Porter, second by Green-Douglass, to approve the Intergovernmental Transfer of Public Funds Agreement between the Iowa Department of Health and Human Services, Des Moines, and Johnson County Ambulance Service, for the transfer of funds regarding Ground Emergency Medical Transportation services provided by Johnson County for Fiscal Year 2025.
Motion by Porter, second by Green-Douglass, to approve the Professional Services Agreement with Eide Bailly LLP, Dubuque, to prepare the Ground Emergency Medical Transportation Program cost report for the fiscal year ending June 30, 2024, in an amount not to exceed $4,500.
