Chairperson Green called the Johnson County Board of Supervisors to order in the Johnson County Health and Human Services Building Boardroom at 9:01 a.m. Members present: V Fixmer-Oraiz, Jon Green, Lisa Green-Douglass, and Rod Sullivan. Members absent: Mandi Remington.
Motion by Green-Douglass and seconded by Fixmer-Oraiz to approve the agenda as presented. Approved unanimously.

PROCLAMATION NO. 05-15-25-01
EMERGENCY MEDICAL SERVICES (EMS) WEEK
MAY 18-24, 2025
Summary: Johnson County recognizes emergency medical services is an essential public service and this is the 51st anniversary of EMS Week with the theme “We Care. For Everyone.” Board action: Proclaim May 18-24, 2025, to be Emergency Medical Services Week in Johnson County, Iowa, and encourage the community to observe this week with activities and programs that recognize the value and the accomplishments of emergency medical services providers.
Motion by Green-Douglass and seconded by Sullivan to approve Proclamation No. 05-15-25-01. Approved unanimously. County Assistant Ambulance Director Ben Symonds spoke.
Convened Public Hearing at 9:11 a.m. on Zoning Application PZC-24-28636 of Brett & Jennifer Keine, requesting rezoning of 1.94 acres from A-Agricultural to R-Residential. The property is located at 6305 Sioux Ave. SE, approximately 2,500 feet north of 640th St. SE, in the NE 1/4 of the SE 1/4 of Section 13, Township 77 North, Range 6 West on the 5th P.M. in Fremont Township, Johnson County, Iowa. Planning, Development, and Sustainability Planner Joseph Wilensky reviewed the application. No one from the public spoke. Public Hearing closed at 9:13 a.m.
Motion by Sullivan and seconded by Fixmer-Oraiz to waive the requirement of three considerations before approving an ordinance amending the Johnson County Unified Development Ordinance, Zoning Application PZC-24-28636 of Brett & Jennifer Keine. Roll call: Aye: Fixmer-Oraiz, Green, Green-Douglass, Remington, Sullivan.
Motion by Sullivan and seconded by Green-Douglass to approve the proposed ordinance associated with PZC-24-28636 of Brett & Jennifer Keine on first and second consideration. Roll call: Aye: Fixmer-Oraiz, Green, Green-Douglass, Remington, Sullivan.
Convened Public Hearing at 9:14 a.m. on Subdivision Application PZC-24-28638 of Brett & Jennifer Keine, requesting preliminary & final plat approval of Westtoot Bluff Second Subdivision. RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER’S AGREEMENT OF WESTTOOT BLUFF SECOND SUBDIVISION, JOHNSON COUNTY, IOWA
Summary: Application PZC-24-28638 was filed for the preliminary and final plat of Westtoot Bluff Second Subdivision, Johnson County, Iowa and the County Zoning Commission recommended the plat be approved. Board action: Approve the plat, direct the Chairperson to sign the plat and all associated documents, and record the following documents: A. Resolution & Documents: Owner’s Certification and Consent to Platting Opinion of Attorney, Certificate of County Auditor Treasurer’s Certificate Subdivider’s Agreement Fence Agreement, Grant of Easement for Public Highway, Resolution Affirming the Stability of the Road System; B. Subdivision Plat (5); C. Right-of-Way Acquisition Plat (5)
Motion by Fixmer-Oraiz and seconded by Green-Douglas to approve Resolution No. 05-15-25-01. Approved unanimously.
Convened Public Hearing at 9:17 a.m. on Subdivision Application PZC-24-28656 of Willis E. Schlabach, requesting preliminary & final plat approval of Barn Yard Acre. The property is located at 5370 Highway 1 SW, in the SW 1/4 of the SW 1/4 of Section 19, Township 78 North, Range 7 West of the 5th P.M. in Sharon Township, Johnson County, Iowa. Wilensky reviewed the application. Scott Ritter of Hart-Frederick Consultants P.C., was present to answer questions. No one from the public spoke. Public Hearing closed at 9:20 a.m.
RESOLUTION NO. 05-15-25-02
RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER’S AGREEMENT OF BARN YARD ACRE, JOHNSON COUNTY, IOWA
Summary: Application PZC-25-28656 was filed for the preliminary and final plat of Barn Yard Acre, Johnson County, Iowa; and the County Zoning Commission recommended that the plat be approved. Board action: Approve the plat, direct the Chairperson to sign the plat and all associated documents, and record the following documents: A. Resolution & Documents: Owner’s Certification and Consent to Platting Title Opinion, Certificate of County Auditor Treasurer’s Certificate Subdivider’s Agreement Fence Agreement, Grant of Access Easement, Resolution Affirming the Stability of the Road System; B. Subdivision Plat (5)
Motion by Sullivan and seconded by Fixmer-Oraiz to approve Resolution No. 05-15-25-02. Approved unanimously.
Motion by Sullivan and seconded by Green-Douglass, to decline the invitation to serve as fiscal agent for the new District 7 Disability Access Point. Approved unanimously.
RESOLUTION NO. 05-15-25-03
WITHDRAW FROM MENTAL HEALTH/DISABILITY SERVICES
OF THE EAST CENTRAL REGION
Summary: Due to changes in Iowa law, the County wishes to provide written notice to withdraw from the Mental Health/Disability Services of East Central Region effective June 30, 2025. Board action: Approve this resolution to act as notice to the Region of the County’s withdrawal from the Region effective June 30, 2025.
Motion by Sullivan and seconded by Green-Douglass to approve Resolution No. 05-15-25-03.
Motion by Fixmer-Oraiz and seconded by Sullivan to adopt the revised Health Insurance Portability and Accountability Act (HIPAA) Policy and Procedures Manual, effective May 15, 2025. Approved unanimously.
Motion by Fixmer-Oraiz and seconded by Green-Douglass to approve the revised job description and pay grade for the position of Mental Health/Disability Services department Case Management Administrator, renaming the position to Director of Case Management department. Approved unanimously.
Motion by Fixmer-Oraiz and seconded by Sullivan to appoint Greg Smith, City of Tiffin, to the Livable Community for Successful Aging Policy Board, to fill a vacancy of a 4-year term expiring June 30, 2027.
