WASHINGTON COUNTY, IOWA
REGULAR MEETING OF TUESDAY, FEBRUARY 27, 2024

At 9:00 am Chair Richard Young called the meeting to order in regular session, Courthouse Chambers. Items on the agenda included: closed session pursuant to Iowa Code section 21.5(1)(c) to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation; discussion/possible action on Res. of matter 4A230596TWK-0001 pursuant to agreement; EMS Advisory Council; Wind Turbine Ordinance Road Use Agreement; Wind Turbine Decommissioning; letter of support for Bridge Investment Program Grant; personnel change request–Public Health; Res. 24-05 related to Notice of Abatement of Taxes. Supervisors Jack Seward Jr., Marcus Fedler, Bob Yoder, and Stan Stoops were also present.
The Board voted to approve the agenda as published.
At 9:04 am the Board voted by way of roll call vote to enter into closed session pursuant to Iowa Code section 21.5(1)(c) to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation,
At 9:42 am the Board voted to return to open session.
The Board voted, based on legal advice received by attorneys representing the Washington County Board of Supervisors during the preceding closed session, to approve the proposed Res. of the matter of 4A230596TWK-001 and for the Washington County Attorney and Auditor to take necessary and appropriate actions to resolve the matter, and for the Chair to sign relevant documents.
The Board next took up discussion/action with re: to modifying the bylaws of the Washington County Emergency Medical Services Advisory Council (Council). Presently the bylaws contain language that defines a quorum as consisting of at least seven members and so in the absence of seven members the Council is unable to take formal action. Board discussion took place regarding reducing the quorum from seven members to five members. Young pointed out that wording contained in Article VI of the bylaws which states that “bylaws may be amended by a two-thirds vote of the members of the council at any two consecutive meetings where more than one half of the Council members are present”. The Board voted to reduce the number of members of the Washington County Emergency Medical Services Advisory Council required to form a quorum from seven to five.
The Board voted to approve the Washington County Road Use Agreement as presented.
The Board took up discussion of rules related to the decommissioning of wind turbines with such discussion focusing on the procedures to inform the county of crane placements, drafting of traffic control plans, and establishing liability for damage caused to County roads by heavy loads and/or equipment. Also discussed was language related to decommissioning procedures which included the maximum amount of time that would be allowed for a wind turbine to be decommissioned after it was no longer in service. Another item of discussion was the practicality and method of making certain that the owner of a wind turbine made certain that adequate funds were available to meet the future and inevitable decommissioning expenses. the Board took no action.
The Board voted to approve a letter of support for a Bridge Investment Program Grant and authorize the Chair to sign such a letter of support. If approved the grant funds would be used to offset the costs of replacing a bridge that spans the Skunk River near McCains Landing.
The Board voted to acknowledge, and authorize the Chair to sign, a personnel change request from Public Health for Public Health Director Emily Tokheim final day of employment will occur on February 29, 2024.
The Board voted by way of roll call vote to approve Res. 24-05 and authorize the Chair to sign Res. 24-05.
At 10:38 am the Board voted to adjourn.
