Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Health and Human Services Boardroom at 5:31 p.m. Members present: V Fixmer-Oraiz, Jon Green, Lisa Green-Douglass, Royceann Porter, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
PUBLIC COMMENT
Resident Emma Denney raised concerns about ongoing challenges for the transgender community due to state legislation and threat of prosecution in Johnson County. Denney urged the Board to adopt sanctuary city laws and policies. Resident Tara McGovern spoke about their experience of being charged by authorities for protesting anti-transgender speakers at the University of Iowa (UIowa) in October 2023. McGovern expressed feeling targeted by the charges and said the decision to pursue charges was the responsibility of the County Attorney’s office. They confirmed yesterday that a Johnson County jury unanimously found them not guilty of all charges. McGovern endorsed Mandy Remmington for the Johnson County Board of Supervisors and encouraged anyone to attend a press conference scheduled for this evening to discuss next steps for various issues.

Motion by Green, second by Fixmer-Oraiz, to receive and place on file the Clerk’s Report of Fees Collected for the month of February, 2024, in the amount of $37,713.95, as submitted by Clerk of District Court Alison Meade.
Convened Public Hearing at 5:42 p.m. on Zoning Application PZC-23-28461 of Andrew Boutte, requesting rezoning of 43.88 acres from A-Agricultural to AG-T-Agritourism. The property is located at 2991 120th St NE, approximately 2,670 feet east of Curtis Bridge Rd NE, in a portion of the NE 1/4 of the NE 1/4 of Section 10 and the W 1/2 of the NW 1/4 of Section 11, all in Township 81 North, Range 7 West of 5th P.M. in Jefferson Township, Johnson County, Iowa.

Convened Public Hearing at 5:47 p.m. on Subdivision Application PZC-23-28464 of Rudy L. & Shannon L. Velky, requesting preliminary & final plat approval of Velky Lane. The property is located at 3366 120th St NE, approximately 3,250 feet east of Hickory Hollow Road NE, in the SE 1/4 of the SE 1/4 of Section 1, Township 81 North, Range 7 West of the 5th P.M. in Jefferson Township, Johnson County, Iowa.

RESOLUTION APPROVING THE PRELIMINARY PLAT OF
SCOTT ROHRETS ADDITION, JOHNSON COUNTY, IOWA
Summary: Application PZC-23-28351, the preliminary plat of Scott Rohrets Addition, is submitted and the Zoning Commission recommends the plat be approved. Board Action: Approved plat and directed the plat be signed. Motion by Green-Douglass, second by Fixmer-Oraiz, to approve Resolution No. 03-14-24-03 effective March 14, 2024.
RESOLUTION NO. 03-14-24-04
RESOLUTION APPROVING THE SITE PLAN SUBMITTED BY SYLVAN SCHLABACH ON BEHALF OF FARMERS HEN HOUSE LLC, FOR THE PROPERTY DESCRIBED AS LOT 2 FARMERS HENHOUSE THIRD SUBDIVISION
Summary: Application PZC-24-28473 was filed for site plan approval to build a cold storage facility on Lot 2 Farmers Henhouse Third Subdivision, located at 5196 Farmers Ave SW, Kalona. The site plan has been reviewed by the County Engineer and Public Health Department, and conforms with the Unified Development Ordinance. The County Engineer recommends waiving some landscaping requirements to ensure traffic safety, and the Zoning Administrator recommends landscaping be placed in an alternate location to allow continuation of existing agricultural production. Board Action: Resolved that said Site Plan be approved, and authorize the Zoning Administrator to issue permits for this site in accordance with the standards set forth in the Johnson County Unified Development Ordinance and subject to the following conditions: a) Prior to issuance of a Certificate of Occupancy for any structures associated with this Site Plan approval, the applicant widen and surface both Farmers Avenue SW and the northern internal drive as shown on the approved Site Plan; b) Prior to issuance of a Certificate of Occupancy for any structures associated with this site plan approval, the underlying property (Lot 2 Farmers Hen House Subdivision) be rezoned to bring the use into compliance with current zoning regulations. Motion by Green-Douglass, second by Green, to approve Resolution No. 03-14-24-04 effective March 14, 2024.
Motion by Fixmer-Oraiz, second by Green, to appoint Lindsey Jones as Human Resources Director.
Motion by Green, second by Green-Douglass, to approve the Memorandum of Understanding with the City of North Liberty, for the Middle Iowa Watershed Management Authority Iowa Department of Natural Resources Comprehensive Water Quality Management Planning Grant, providing a local match using American Rescue Plan Act (ARPA) Local Fiscal Recovery Funds in the amount of $91,000.
Motion by Green-Douglass, second by Fixmer-Oraiz, to approve the ARPA Subrecipient Agreement between Johnson County Public Health and the University of Iowa College of Nursing, Iowa City, for doula services, in an amount not to exceed $124,870.
Motion by Green-Douglass, second by Fixmer-Oraiz, to approve the new Service Animals Policy within the Americans with Disabilities Act (ADA) section of the Employee Handbook, effective March 14, 2024.
Motion by Green, second by Green-Douglass, to approve the Agreements for Acceptance of Donated Right-of-Way with Josephine Kathryn Wieland and Larry R. Tener /Janis Tener, for the Naples Avenue SW Bridge Replacement over Crooked Creek, known as Project LFM-R-32-1--7X-52.
Motion by Green-Douglass, second by Green, to set a bid letting date of April 9, 2024 for Project LFM-R-32-1--7X-52 and authorize the Auditor to publish the Notice to Bidders.
Motion by Green-Douglass, second by Green, to approve the Byrne Justice Assistance Grant State Crisis Intervention Program Contract with the Iowa Department of Public Safety - Office of Drug Control Policy, Des Moines, for Project BRAVE at the GuideLink Center, in the amount of $122,790.
Motion by Fixmer-Oraiz, second by Green-Douglass, to approve the Johnson County Historic Poor Farm Land Use Agreement with Lee and Melinda Turnbull for crop production, effective March 1, 2024 to February 28, 2027.
Motion by Green-Douglass, second by Fixmer-Oraiz, to approve Change Order No. 3 for the Johnson County Courthouse Second Level Courtroom Renovation Project with Tricon General Construction, Inc., Cedar Rapids, in the amount of $45,553.91.
Motion by Green-Douglass, second by Green, to approve Change Order No. 22-PR 16 for the Johnson County Courthouse Second Level Courtroom Renovation Project with Tricon General Construction, Inc., Cedar Rapids, in the amount of $2,862.00.
Motion by Green, second by Fixmer-Oraiz, to approve Change Order No. 23-PR 24 for the Johnson County Courthouse Second Level Courtroom Renovation Project with Tricon General Construction, Inc., Cedar Rapids, in the amount of $2.276.03.
Motion by Green-Douglass, second by Fixmer-Oraiz, to approve Change Order No. 26-PR- 25 for the Johnson County Courthouse Second Level Courtroom Renovation Project with Tricon General Construction, Inc., Cedar Rapids, in the amount of $1,484.56.
Motion by Fixmer-Oraiz, second by Green, to approve Change Order No. 27 for the Johnson County Courthouse Second Level Courtroom Renovation Project with Tricon General Construction, Inc., Cedar Rapids, in the amount of $3,201.79.
Motion by Green, second by Green-Douglass, to approve Change Order No. 25 for the Johnson County Courthouse Second Level Courtroom Renovation Project with Tricon General Construction, Inc., Cedar Rapids, in the amount of $3,390.04.
Hearing no objections from Board members, Sullivan stated agenda item F.1.p. Consider Johnson County Sheriff’s Office Collective Bargaining Agreement between Johnson County Board of Supervisors and Public Professional and Maintenance Employees (PPME), IUPAT Local 2003, effective July 1, 2024 to June 30, 2026, is deferred until further notice.
