Chairperson Green-Douglass called the Johnson County Board of Supervisors to order in the Johnson County Administration Building Boardroom at 9:00 a.m. Members present: V. Fixmer-Oraiz, Jon Green, Lisa Green-Douglass, Royceann Porter, and Rod Sullivan.
All actions were taken unanimously.
Motion by Green, second by Porter, to approve the claims on the Auditor’s Claim Register for June 22, 2023, as approved by a majority of the Supervisors.

AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM A-AGRICULTURAL TO R-RESIDENTIAL
Summary: The purpose of this ordinance is to amend the Johnson County Unified Development Ordinance by changing the classification of the real estate located in Union Township as described below from A-Agricultural to R-Residential:
LEGAL DESCRIPTIONS
A portion of the SW1/4 SE1/4, Section 10, T.79N., R.07W., of the Fifth P. M., Johnson County, Iowa, located within the Deed recorded in Bk. 6450 – Pg. 12, Johnson County Recorder’s Office, described as follows: Commencing at the NE corner of said SW1/4 SE1/4, Section 10, as marked by a found 5/8” rebar, as depicted on Plat of Survey recorded in PBk. 36 – Pg. 154; Thence S 01° 06’ 43” E – 20.00 ft., along the east line of said SW1/4 SE1/4, to a point on the south ROW line of the Public Road, which is the Point of Beginning of this Rezoning Parcel; Thence S 01° 06’ 43” E – 339.66 ft., along said east line; Thence N 88° 42’ 29” W – 233.76 ft.; Thence N 04° 08’ 05” W – 334.44 ft., to said south ROW line; Thence N 89° 49’ 39” E – 251.22 ft., along said ROW line, to the Point of Beginning. AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM A-AGRICULTURAL TO CH-COMMERCIAL HIGHWAY AND ML-LIGHT INDUSTRIAL
Summary: The purpose of this ordinance is to amend the Johnson County Unified Development Ordinance by changing the classification of the real estate located in Jefferson Township as described below from A-Agricultural to CH-Highway Commercial and ML-Light Industrial. This change in classification is subject to that Conditional Zoning Agreement agreed to by the property owner, Todd Philipp.

RESOLUTION NO. 06-22-23-01
RESOLUTION SETTING A PUBLIC HEARING ON VARIOUS DEVELOPMENT APPLICATIONS AND A TEXT AMENDMENT TO THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE
Summary: The Johnson County Planning and Zoning Commission has filed its report and recommendations for certain actions. Board Action: Set public hearing for July 13, 2023, at 5:30 CT in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following applications: Rezoning applications filed by Anne Murphy (PZC-23-28360), Kristen L. Brenneman (PZC-23-28361), Troy and Beth Wolfs (PZC-23-28362), and Mike and Angela Eads (PZC-23-28363); Subdivision applications filed by Kristen L. Brenneman (PZC-23-28365), and Troy and Beth Wolfs (PZC-23-28366); and An Ordinance amending the Johnson County Unified Development Ordinance to update and modify certain definitions and requirements for environmental regulations, grading permits, and erosion control and site stabilization, and authorized the Auditor to publish the official notice of above public hearing. Motion by Fixmer-Oraiz, second by Porter, to approve Resolution No. 06-22-23-01, effective June 22, 2023.
Motion by Green, second by Fixmer-Oraiz, to approve the Master Services Agreement with Pigott, Cedar Rapids, for professional services associated with the Administration and Health and Human Services Buildings Remodel Project, as contained in the agenda packet of this meeting.
RESOLUTION No. 06-22-23-02
RESOLUTION APPROVING THE ESTABLISHMENT, ELIGIBILITY, SELECTION, AND REQUIREMENTS FOR THE JOHNSON COUNTY CHILD CARE ASSISTANCE INCENTIVE PROGRAM FUNDED BY AN APPROPRIATION FROM LOCAL FISCAL RECOVERY FUNDS FROM THE AMERICAN RESCUE PLAN ACT
Summary: The U.S. Department of the Treasury has allocated federal funding through the American Rescue Plan Act (ARPA) to Johnson County to be used only for specified limited purposes and ARPA authorizes the County to expend ARPA funds awarded to respond to the COVID-19 public health emergency or its negative economic impacts.
The economic crisis caused by the pandemic worsened economic outcomes and increased disparities for many low income families and child care business entrepreneurs and increased child care insecurity or child care access barriers for child care insecure households. The Board approved the use of ARPA funds to support child care initiatives in Johnson County on November 30, 2022.
A selective application process with eligibility requirements and evaluation criteria may be established. Child care businesses and organizations led by individuals facing inequities in the child care system including Black, Indigenous, and other people of color, female identifying, non-binary, and trans people, and people living with disabilities are encouraged to apply to the Child Care Assistance Incentive Program.
Board Action: Resolved that the Child Care Assistance Incentive Program serves a public purpose by providing resources for a strong, equitable economic recovery, and agreed that such support will be conducive to the beneficiaries’ welfare and the best interests of the public.
Established the Child Care Assistance Incentive Program to provide funding to eligible and selected child care businesses that provide child care services in Johnson County, or who enable the carrying out of such activities, and where such activities impact residents of Johnson County, including child care services in Johnson County.
Defined that the Child Care Assistance Incentive Program will accept applications from eligible entities for a set application period and will determine awards through a review and recommendation process facilitated by Johnson County Social Services.
Authorized and approved the Child Care Assistance Incentive Program and set a cap of $575,000 to be appropriated from Department 35 to fund said program expenditures with anticipation that all funds will be used and the County’s involvement in this program will end no later than December 31, 2026.

Board Action: Resolved that the Infant and Toddler Scholarship Program serves a public purpose by providing resources that lay the foundation for a strong, equitable economic recovery consistent with the Final Rule, and agreed that such support will be conducive to the beneficiaries’ welfare and the best interests of the public; and be it further
Established the Infant and Toddler Scholarship Program to provide child care tuition assistance funding to income eligible working parents with children birth to three years of age.
Defined that the Infant and Toddler Scholarship Program will accept applications from eligible entities for a set application period and will determine awards through a review and recommendation process facilitated by Johnson County Social Services.
Authorized and approved the Infant and Toddler Scholarship Program and set a cap of $1,750,000 to be appropriated from Department 35 to fund said program expenditures with anticipation that all funds will be used and the County’s involvement in this program will end no later than December 31, 2026.
Motion by Porter, second by Green, to approve Resolution No. 06-22-23-03, effective June 22, 2023.
Motion by Porter, second by Fixmer-Oraiz, to approve the Service Agreement to Participate in the ISAC HIPAA Program with the Iowa State Association of Counties, for online training on a variety of Health Insurance Portability and Accountability Act Program related issues, for Fiscal Year 2024, in an amount of $1,750.
Motion by Sullivan, second by Green, to approve the Johnson County Fund Balance Policy as contained in the agenda packet of this meeting.
Motion by Green, second by Porter, to approve the Agreement to Provide Juvenile Detention Services with Linn County for Fiscal Year 2024.
