Vice-Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building Boardroom at 1:31p.m. Members present: V. Fixmer-Oraiz, Jon Green, Royceann Porter, and Rod Sullivan. Members absent: Lisa Green-Douglass.
All actions were taken by the following vote: Aye: Fixmer-Oraiz, Green, Porter, and Sullivan; absent: Green-Douglass.
Motion by Porter, second by Fixmer-Oraiz, to approve the claims on the Auditor’s Claim Register for July 19, 2023, as approved by a majority of the Supervisors.

Motion by Green, second by Porter, to approve the Application for a Class C Retail Alcohol License for Apres Bar Co, Des Moines, as submitted by Jillian Harrington.
Motion by Porter, second by Fixmer-Oraiz, to approve the alcohol license applications as contained in the agenda packet of this meeting as follows:
Pending recommendations for approval from the Zoning Administrator:
1. 5-day Special Class C Retail Alcohol License for Backpocket Brewing LLC, Coralville, as submitted by Aaron Vargas
2. 5-day Class C Retail Alcohol License for Iowa Beer Bus, Pleasantville, as submitted by Michael Mott

Motion by Green, second by Fixmer-Oraiz, to receive and place on file the Auditor’s Quarterly Report of Fees Collected for the quarter ending June 30, 2023, in the amount of $32,129.53, as submitted by County Auditor Travis Weipert.
The Board acknowledged receipt of the June 12, 2023 Planning and Zoning Commission Meeting Minutes, and the July 10, 2023 Report of the Planning and Zoning Commission.

Summary: The purpose of this ordinance is to amend the Johnson County Unified Development Ordinance by changing the classification of the real estate described below from A-Agricultural and R-Residential to R-Residential and located in Oxford Township to wit:
LEGAL DESCRIPTION
REZONE A-AGRICULTURAL & R-RESIDENTIAL to R-RESIDENTIAL
Being a part of Lot 1 of Trails End Subdivision as is recorded in Plat Book 34 on page 315 in the office of the Johnson County Recorder and is described as:
Commencing at the Northeast corner of said Lot 1; thence S 01°00’39” E along the East line of said Trail End Subdivision, a distance of 41.31 feet to the Point of Beginning; thence continuing S 01°00’39” E along said East line, a distance of 750.61 feet to the Southeast corner of said Lot 1; thence S 87°18’15” W along the South line of said Lot 1, a distance of 277.58 feet to the Southwest corner of said Lot 1; thence N 01°00’39” W along the West line of said Trails End Subdivision, a distance of 896.47 feet; thence S 64°36’57” E, a distance of 309.76 feet to the Point of Beginning containing 5.24 acres.

Motion by Porter, second by Green, to approve the proposed ordinance associated with Zoning Application PZC-23-28362 on third and final consideration and approve Ordinance No. 07-19-23-03 amending the Johnson County Unified Development Ordinance. Roll call: Aye: Fixmer-Oraiz, Green, Porter, and Sullivan; absent: Green-Douglass.
Third and final consideration of the proposed ordinance associated with Zoning Application PZC-23-28363. Assistant Planning, Development and Sustainability Director Nate Mueller stated an error was discovered in the legal description for PZC-23-28363. After consulting with the County Attorney, they agreed that the best course of action is for the Board to reconsider the three ordinance readings with the corrected legal description. Mueller said PDS staff will reschedule this application for Board consideration, and no action is needed today.
Motion by Green, second by Fixmer-Oraiz, to approve, on second consideration, an ordinance amending the Johnson County Unified Development Ordinance to update and modify certain definitions and requirements for environmental regulations, grading permits, erosion control and site stabilization as contained in the agenda packet of this meeting, with one amendment as follows: in Section two, paragraph a, striking the word “excluding” and replacing it with “which measure 5000 square feet or greater, excluding…”.

RESOLUTION SETTING A PUBLIC HEARING ON VARIOUS DEVELOPMENT APPLICATIONS AND A TEXT AMENDMENT TO THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE
Summary: The Johnson County Planning and Zoning Commission filed its report and recommendations for certain actions.
Board Action: Set a public hearing for August 10, 2023, at 5:30 CT in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following applications: a) Rezoning applications filed by Stephen Hauser signed by Wade Wamre (PZC-23-28376), Donald Beuter Estate signed by Megan Beuter n/k/a Megan Bradford (PZC-23-28377), and Evelyn Kral signed by Ron Kral (PZC-23-28381); and b) Subdivision applications filed by Evelyn Kral signed by Ron Kral (PZC-23-28384), Paul Peterson (PZC-23-28383), Donald Beuter Estate signed by Megan Beuter n/k/a Megan Bradford (PZC-23-28379), Jesse and Aaron TeBockhorst signed by Thomas Anthony (PZC-23-28382), Stephen Hauser signed by Wade Wamre (PZC-23-28378), and Brad Amendt (PZC-23-28364); and c) An Ordinance amending the Johnson County Unified Development Ordinance to update and modify certain definitions and requirements for subdivision regulations and performance agreement contingency requirements. Authorized the Auditor to publish the Notice of Public Hearing. Motion by Fixmer-Oraiz, second by Green, to approve Resolution No. 07-19-23-01, effective July 19, 2023.
The Board acknowledged Receipt of the Petition to Vacate the Preliminary and Final Plat of Kauffman Rolling Acres Subdivision Recorded in Book 58, Page 118, Johnson County Recorder’s Office.
RESOLUTION NO. 07-19-23-02
RESOLUTION SETTING A PUBLIC HEARING ON PETITION TO VACATE THE PRELIMINARY AND FINAL PLAT OF KAUFFMAN ROLLING ACRES SUBDIVISION
Summary: Hali Hanson and James Hanson filed a petition to vacate the preliminary and final plat of Kauffman Rolling Acres Subdivision.
Board Action: Set a public hearing for August 10, 2023, at 5:30 P.M. CT in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following: a) Petition to Vacate the Preliminary and Final Plat of Kauffman Rolling Acres Subdivision. Authorized publication of the official public hearing notice.
Motion by Green, second by Porter, to approve Resolution No. 07-19-23-02, effective July 19, 2023.
Motion by Porter, second by Fixmer-Oraiz, to approve the FY24 Quality of Life Grant Agreement between the Johnson County Board of Supervisors and the City of North Liberty for $1,500.
Motion by Green, second by Porter, to approve the FY24 Quality of Life Grant Agreement between the Johnson County Board of Supervisors and the Johnson Clean Energy District for $20,000.
Motion by Porter, second by Fixmer-Oraiz, to approve the East Central Local Workforce Development Area Grant Agreement #23-N-EC-WI-OA Assignment and Modification with Iowa Workforce Development to transfer the WIOA grant recipient relationship from Johnson County to East Central Iowa Local Workforce Development Board for FY24.
Motion by Green, second by Fixmer-Oraiz, to consider the job description for the new position of Board Office Communications Manager.
Sullivan acknowledged the 28E Agreements for Paratransit Service with the City of Coralville and with the City of Iowa City (agenda items m and n) are not ready for consideration at this time and will be scheduled for a vote at the next formal Board of Supervisors meeting.
Motion by Green, second by Porter, to approve the Quote to Move Furniture and Items to Temp Space and Storage (CR2314720) from T&M Services for moving services related to the Administration and Health & Human Services Buildings Remodeling Project in an amount of $84,310.
Motion by Green, second by Fixmer-Oraiz, to approve an Application for Fireworks Permit for Tyler Roger, for display at 2965 IWV Road, Oxford, on July 28, 2023, with a July 29, 2023 rain date.
