Chairperson Green-Douglass called the Johnson County Board of Supervisors to order in the Johnson County Health and Human Services Boardroom at 5:32 p.m. Members present: V Fixmer-Oraiz, Jon Green, Lisa Green-Douglass, Royceann Porter, and Rod Sullivan.

PUBLIC COMMENT
City of Tiffin (Tiffin) resident Mary McCann recognized Porter’s commitment to supporting families whose children attend the Clear Creek Amana School District, highlighting her efforts to promote diversity and inclusion. Johnson County Public Health Community Health Division Manager Sam Jarvis encouraged the public to get their COVID-19 and flu vaccinations during this winter season. Joan Young Ambrose of Swan Lake Road Farms, LLC stressed the need for local control over transmission line use and preservation of road right-of-ways. Johnson Clean Energy District (JCEP) Board President and Chief Administrator Craig Mosher thanked the Board for the Quality Of Life Grant used to establish the JCEP Energy Coaching Program.

Motion by Sullivan, second by Fixmer-Oraiz, to approve the alcohol license application from the Celebration Farm, Iowa City, as contained in the agenda packet of this meeting.
Motion by Green, second by Sullivan, to receive and place on file the Clerk’s Report of Fees Collected for the month of November, 2023, in the amount of $31,108.69, as submitted by Clerk of District Court Alison Meade.
Convened Public Hearing at 5:45 p.m. on Zoning Application PZC-23-28330 of PCR Investments SP2, LLC, requesting rezoning of 50 acres from A-Agricultural to RE-Renewable Energy. The property is located in the northwest quadrant of the intersection of Sioux Ave SE and Highway 22 SE, in the E 1/2 of the SE 1/4 of Section 1, Township 77 north, Range 6 West of the 5th P.M. in Fremont Township, Johnson County, Iowa.
Assistant Planning, Development, and Sustainability (PDS) Director Nate Mueller reviewed the application. PCR US Investments Corp. Chief Commercial Officer Manuel Arancibia and PCR Investments SP2, LLC President Mariano Brandi* were present to answer questions. Mosher spoke for the application. Motion by Sullivan, second by Green, to approve the proposed ordinance associated with Zoning Application PZC-23-28330 on first and second consideration, as outlined in the resolution. After receiving clarification from the County attorney, Sullivan revised his motion to approve the proposed ordinance associated with Zoning Application PZC-23-28330 on first and second consideration, subject to the conditions as outlined in the ordinance. Convened Public Hearing at 6:10 p.m. on Subdivision Application PZC-23-28415 of Mary A. Halva Estate, requesting preliminary & final plat approval of Halva Haven Subdivision. The property is located on the south side of 120th St NW, approximately 1,540 feet west of Baxter Ave NW, in the NE 1/4 of the NW 1/4 of Section 7, Township 81 North, Range 8 West of the 5th P.M. in Monroe Township, Johnson County, Iowa.

Board Action: Approved the plat, directed the plat and Subdivider’s Agreement be signed, and named the documents to be recorded. RESOLUTION NO. 12-14-23-04
RESOLUTION APPROVING THE FRINGE AREA POLICY AGREEMENT BETWEEN JOHNSON COUNTY, IOWA AND THE CITY OF NORTH LIBERTY, IOWA
Summary: The City and County entered into a 28E Agreement in March 2014 pertaining to the City / County Fringe Area. Staff of both entities developed a new agreement to supersede and replace the March 2014 fringe area agreement. North Liberty reviewed and approved said agreement by resolution. The Johnson County Planning and Zoning Commission reviewed and recommended said agreement be approved. Board Action: The Board agrees to the Fringe Area Policy Agreement between Johnson County and the City of North Liberty as recommended by the Planning and Zoning Commission as contained in the agenda packet for the Board meeting held December 14, 2023, copies of which can be obtained at the Johnson County Planning, Development and Sustainability Office, the Johnson County Auditor’s Office, or at www.johnsoncountyiowa.gov. Authorized and directed the Chairperson to sign said Fringe Area Policy Agreement and arrange for its filing with the Iowa Secretary of State as required by Iowa Code Sec. 28E.5 upon full execution by the parties. RESOLUTION NO. 12-14-23-05
RESOLUTION OF THE JOHNSON COUNTY BOARD OF SUPERVISORS AUTHORIZING THE TRANSFER OF $8,100.00 TO THE JOHNSON COUNTY EMERGENCY MANAGEMENT AGENCY AND COMMISSION, FOR THE LOCAL MATCHING FUNDS, FOR COMPLETION OF A FEMA COUNTYWIDE HAZARD MITIGATION PLAN
Summary: The Federal Emergency Management Agency (FEMA) is making available funds from the Hazard Mitigation Assistance Program (HMAP) for planning. The State and FEMA require communities to adopt an approved hazard mitigation plan to be eligible for federal funding. The Johnson County Emergency Management Agency requests funding for the 30% local cash match in the amount of $8,100 for this plan, while the State and FEMA provide the $27,000 plan cost balance. Board Action: Resolved to approve the transfer of funds in the amount of $8,100 to the Johnson County Emergency Management Agency for the EMA Commission to carry out the execution of the planning work with Two Rivers Consulting, with a completion date for adoption no later than December 31, 2024. Motion by Sullivan, second by Porter, to approve Resolution No. 12-14-23-05 effective December 14, 2023.
Motion by Fixmer-Oraiz, second by Green, to approve Amended and Restated 28E Agreement between Johnson County, Johnson County Emergency Management Agency, the University of Iowa, and the cities of Coralville, North Liberty, Cedar Rapids, and University Heights, for the joint provision of underwater search and recovery operations in the cooperating jurisdictions, as contained in the agenda packet of this meeting.
Motion by Green, second by Fixmer-Oraiz, to approve the Utility Occupancy and Location Agreement, Bond, and Utility Permit #11503 for the River Heights Property Owners Association water main upgrade and/or replacement on and near W66 (Dubuque Street NE) as contained in the agenda packet of this meeting.
Motion by Porter, second by Sullivan, to approve the 28E County-City Law Enforcement Services Agreement with the City of Tiffin, for the Sheriff to provide law enforcement services through Fiscal Year 2029. Roll call: Aye: Green-Douglass, Porter, Sullivan; Nay: Fixmer-Oraiz, Green.

FISCAL YEAR 2024 APPROPRIATION CHANGES TO
PHYSICAL PLANT (DEPT. 17) AND INSURANCE (DEPT. 22)
Summary: Appropriations for the Insurance Department are not sufficient to meet payments, and the Physical Plant Department has available budget funds. Board Action: Resolved that Insurance (Dept. 22), Administration Service Area, is appropriated an additional $100,000 and a total appropriation of $1,460,000 for fiscal year 2023-2024. The appropriation for Physical Plant (Dept. 17), Administration Service Area, is decreased $100,000 for a total appropriation of $2,272,418 for fiscal year 2023-2024. The relevant county service area is Administration, which remains unchanged. Motion by Porter, second by Green, to approve Resolution No. 12-14-23-06 effective December 14, 2023.
